The Bombay High Court at Goa has invalidated the Directorate of Health Services’ decision to reject the technical bid of Mahalsa Services, a cleaning contractor. The rejection was based on the grounds that the contractor failed to qualify for the bidding process.
The High Court has remanded the matter back to the Directorate of Health Services for re-examination, instructing the technical evaluation committee to assess whether the petitioner meets the qualifying criteria. If qualified, the financial bid of the petitioner must be considered alongside those submitted by other respondents.
The tender was for environmental support services, operations, and maintenance at various health facilities and offices.
